What Rights Do I Have If I Am Accused of Using AI to Cheat?

Being accused of using AI tools improperly can be stressful and confusing. However, students have important rights during the academic misconduct process.

Consult Your School Policies and Your Syllabus

Your school should have detailed policies of how academic integrity violations, like the misuse of AI, are handled including the rights each student has and how those rights are protected. Institutions vary in their processes and the protections afforded to students. Read the policies, speak to administration handling academic integrity violations, and know how your school handles these violations. Many schools offer in person hearings where an attorney may represent you and some only handle written or virtual hearings. Some schools allow you to have an advisor only and some require you to be alone in the hearing. Know the rules for your school.

In general, all students are owed the following rights although the form and practicality may vary based upon your institution.

Key rights include:

  • Right to be informed: You must receive clear details of the accusation, including evidence.

  • Right to respond: You can explain your side of the story and provide supporting documents.

  • Right to representation: Some schools allow a trusted advisor, mentor, or legal representative during hearings.

  • Right to a fair process: Institutions must follow their published academic integrity policies, ensuring impartial investigations.

  • Right to appeal: If found responsible, you usually have the ability to appeal the decision through formal channels.

Understanding and exercising your rights can help protect your academic future.
